In a recent interview, Daryl Weinman, founding partner at Weinman & Associates in Austin, TX, revealed how to survive a four-way meeting during a divorce settlement.

When asked to comment, she said, “For many, an extremely stressful aspect of the divorce process is sitting across from your spouse in a four-way meeting and speaking about personal matters in front of attorneys.”
Weinman added that this concern is further exacerbated for anyone who has been exposed to domestic violence, threats, and harassment in the relationship.
However, according to her, a four-way meeting, which is not mandatory at any point in the divorce process, can produce favorable outcomes and can considerably reduce the cost of the divorce when considering the following advice.
Ensuring the client and attorney are on the same wavelength can go a long way in achieving a productive meeting.
When asked to elaborate, she explained, "Before the meeting, consult with your lawyer to discuss your goals, priorities, and what you wish to get out of the conference. You should also discuss whether or not you'd like to actively participate in negotiations or if you'd like your attorney to speak on your behalf."
“This is a great way to present a united front with your legal representation and to avoid any surprises, which is the last thing you want,” Weinman added.
Another tip that Weinman gives her clients is to keep emotions at bay.
“During my years of representing clients going through divorces, I've seen that it's quite tempting – and detrimental – for couples to jump down each other's throats and make derogatory comments. A session like this should not be viewed as an opportunity to vent. This does nothing aside from harboring ill will and distracting from the main aim of the meeting. It’s much better to keep a pad and pen in front of the client so they can take notes, or remind themselves of what they want to discuss with their attorney."
“Instead, keeping a cool head and calm demeanor will go much further in achieving the goals that you and your attorney set out to accomplish in the meeting,” she said.
To avoid conflict, Weinman also recommends striking compromises in the meetings within reason. However, there is no requirement to actually reach any agreements during these meetings. Information can be exchanged, offers can be discussed, and then decisions can be made after the meeting.
“When coming up with terms of any potential agreements, I definitely recommend keeping an open mind and weighing all options. Of course, you wouldn't want to receive the shorter end of the stick while negotiating, but it's better to be flexible when a solution might be beneficial to both sides."
Weinman was quick to add that narrowing the focus to answers that will be advantageous to everyone involved, and treating this from the point of view of a business negotiation will result in a cheaper and much less stressful divorce. If the couple can imagine themselves as being in the business of raising their kids, and if they can recognize that dividing the estate is simply dissolving a business partnership, they will get through the process with a lot less emotional and financial damage.
